Modernised trademark rules and new law on business names

Legislation on trademarks is to be modernised and simplified. For example, it will no longer be necessary that symbols can be reproduced graphically for them to be recognised as trademarks. The Riksdag voted in favour of the Government's proposal.

The Government notes that trademarks have acquired an increasingly important role in company development, both in Sweden and globally. For Swedish companies to be able to compete in the best possible way, the rules need to be simple, predictable and neutral.

The changes mean, among other things, that Swedish trademark legislation is being brought closer to legislation in other EU countries. The new legislation is also more technology neutral as regards trademarks. It will no longer be necessary that symbols can be reproduced graphically for them to be recognised as trademarks. This makes it easier, for example, to register sound trademarks or motion trademarks.

The Riksdag voted in favour of the Government's proposal. The amendments will come into force on 1 January 2019.
